The prospective students are advised to read the following legal aspects / Disclaimer and understand them. The Institutions: Dr. A.P.J. ABDUL KALAM UNIVERSITY student support service provider, Supreme Techno Global Univarsity, educational unit of Supreme Techno Associates Private Limited (STA), Chennai, India, hereinafter referred to as the Institutions. Enrolment Agreement: The “Application for Admission” is the Enrolment Agreement (hereinafter referred to as the Agreement) between the applicant and the Institutions. Entire Agreement: This Agreement constitutes and expresses the entire agreement and understanding between the Institutions and the students of the Institutions in reference to all matters herein referred to, all previous discussions, promises, representations, and understandings relative thereto, if any, had between the parties hereto, being herein merged. Interpretation: The Masculine, Feminine or neuter gender and the singular or plural number shall be deemed to include the other gender or numbers were the context so indicates or requires. Unless otherwise expressly provided, references to days, months or years are to calendar days, months or years. Person or persons include individuals, partnerships, corporations, government agencies or other entities. Section headings are included for convenience only and are not to be used to construe or interpret this agreement. No Third Party Beneficiaries: Enrolment of any candidate in the Programs, shall not entitle any person (including, without limitation, members) to any rights as third party beneficiary. No Obligation to Services, etc. The Institutions has no obligation to render any services to the student members beyond 4 years, after the date of enrolment. To clarify further, no obligation of the Institutions shall survive beyond 4 years after the date of enrolment. Limitation of Liability: The liability of the Institutions towards the student is limited only to the extent of the fee paid by them. To clarify further, the Institutions shall not be liable to the students for punitive, exemplary, special, indirect, or consequential damages, including, without limitation, lost profits. Assignment: The students of the Institutions cannot assign this Agreement nor any part there of the Institutions may, without necessity of the students consent, assign its rights and obligations under this agreement to a successor organization. Force Majeure: The Institutions shall not be liable for delay or failure in performance of any of its obligations under the Agreement when such delay or failure arises from events or circumstances beyond the reasonable control of the Institutions (including, without limitation, acts of God, fire, flood, war, explosion, sabotage, terrorism, embargo, civil commotion, acts or omissions of any government entity, supplier delays, communications or power failure, equipment or software malfunction, or labor disputes).Dr. A.P.J. ABDUL KALAM UNIVERSITY, USA: Dr. A.P.J. ABDUL KALAM UNIVERSITY, Inc., USA, provides degrees and diplomas to students, free of charges, on the recommendations of the Institutions, as a service to humanity. It does not deal with the students directly and has no direct connection with them. There is no binding contract between AKU, USA, and the students. Therefore, AKU, USA, is not legally bound to any dispute that is aroused by the students. AKU is not accredited by any accrediting bodies recognized by US Government agencies as reliable accrediting agencies - as mentioned by the U.S. Department of Education. Indemnity: A student of the Institutions agrees to indemnity (including AKU, USA), defined and hold the Institutions harmless from and again any and all loss, damage, liability, and expense (including reasonable attorneys’ fees and costs) arising out of any third party claim, action or proceeding based directly or indirectly on the acts of commission or commission by the member of his / her agents, the breach or alleged breach or failure to comply with any applicable laws or regulations. Applicable Law: The Agreement shall be deemed to have been made in Chennai in the State of Tamil Nadu, India and shall be constructed and enforced in accordance with and the validity and performance hereof shall be governed by the laws of the State of Tamil Nadu, India without reference to principles of conflict of laws thereof. Judicial proceedings regarding any mater arising under the terms of the Agreement shall be brought in the relevant courts of Chennai, India. Jurisdiction for all disputes (if any) relating to the Institutions is Chennai, India. The Institutions reserves the right to change the curriculum, course structure and the rules relating to administration, admissions, examinations, fee structure, and all other matters relating to the programs. This document is prepared by the Institutions at their sole discretion and cost. This Document does not create a binding contract between the Institutions plans on the date of publication of this document. Details may be modified from time to time for academic and operational reasons. The students will be governed by the latest regulations applicable to them during the relevant academic year. This document is designed to provide the prospective students with information on educational programs only. Neither the Institutions nor any party assumes any liability of any kind to any persons for providing this information, Whether or not such persons rely on it and even if they inform the Institutions of their reliance on it.
